These Terms and Conditions (“Agreement”) constitute a legal agreement between you and Association for Christian Thoughtfulness, a Society registered under provisions of the Societies Registration Act, 1960 and having registration number F-5727 (Bombay) (hereinafter also referred to as ‘ACT’ or ‘the organisation’). By accessing the actnowindia.org website, currently located at https://actnowindia.org (the “Site” or “Website”), or using any of the Services accessible through the Site, you become a user and agree to, and are bound by, the terms of this Agreement, as amended by ACT. As per our discretion, we may update this Agreement. Throughout this Agreement, the words “ACT,” “us,” “we,” and “our”, shall refer to our organisation ‘Association for Christian Thoughtfulness’.

If you are an individual entering into this Agreement “you” refers to you the individual. If you are entering into this Agreement on behalf of an organisation or company you represent and warrant that you have the authority to bind the organisation or company or institution to this Agreement, in this instance, “you” shall refer to the organisation or company or institution.

If you do not agree to these Terms and Conditions please do not continue using our Site or Service. As the need arises, ACT may make changes to the Terms and Conditions, you must agree to any such changes before continuing to use our Site or any Service.

You should visit this page periodically to re-appraise yourself of the Terms and Conditions, because they are binding on all users of this Website. Any new pages or functionality which is added to the Site shall also be subject to the Terms and Conditions. You may not sell or modify the content of this Website or reproduce, display, publicly perform, distribute, or otherwise use the materials in any way for any public or commercial purpose without the organisation’s written permission.

(A) Security Rules

The organisation and / or its associate entities will have the right to investigate occurrences that they suspect as involving such violations and will have the right to involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations.

(B) General Rules

Visitors may not use the Website in order to transmit, distribute, store or destroy material (a) that could constitute or encourage conduct that would be considered a criminal offence or violate any applicable law or regulation, (b) in a manner that will infringe the copyright, trademark, trade secret or other intellectual property rights of others or violate the privacy or publicity of other personal rights of others, or (c) that is libellous, defamatory, pornographic, profane, obscene, threatening, abusive or hateful.

We reserve the right to terminate your use of the Site or any related website for violating any of the prohibited uses.

(D) Online Donation Form

This option is to aid in reconciliation of donations credited to our account. Donors are requested to submit the Donation Form immediately after making a Donation.

Personal Information

Your submission of personal information through the Online Donation Form and Newsletter Subscription is governed by our Privacy Policy.

Accuracy, Completeness and Timeliness of Information

Occasionally there may be information on our site that contains typographical errors, inaccuracies or omissions. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information if any information in the website is inaccurate at any time without prior notice. We undertake no obligation to update, amend or clarify information in the website, except as required by law. We are also not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate sources of information. Indemnity

You agree to defend, indemnify and hold harmless ACT, their officers, directors, employees, affiliates and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from:

  • your use of and access to the Site or Service.
  • your violation of any term of these Terms and Conditions.
  • any claim that your actions or actions using your account harmed a third party.

You also agree that you have a duty to defend us against such claims and we may require you to pay for an attorney(s) of our choice in such cases. You agree that this indemnity extends to requiring you to pay for our reasonable attorneys’ fees, court costs, and disbursements. In the event of a claim such as one described in this paragraph, we may elect to settle with the party/parties making the claim and you shall be liable for the damages as though we had proceeded with a trial.

Liability

User agrees that ACT, its members, staff and website administrators shall not be liable for any direct or/and indirect or/and incidental or/and special or/and consequential or/and exemplary damages, resulting from the use or/and the inability to use the Site.

Disclaimer of Consequential Damages

In no event ACT or any parties, organisations or entities associated with the organisation mentioned in this Website, be liable for any damages whatsoever (including, without limitations, incidental and consequential damages, lost profits, or damage to computer hardware or loss of data information or operational interruption) resulting from the use or inability to use the Website and the Website material, whether based on warranty, contract, tort, or any other legal theory, and whether or not, such organisation or entities were advised of the possibility of such damages.

General Terms

The Site and any Services may be modified, updated, interrupted, suspended, or discontinued at any time without notice to you or liability to ACT. If you object to any modifications, your sole recourse is to stop using the Site or Services. Continued use of the Site or Services following modifications shall indicate your acknowledgement of such modifications and agreement to use the Site and Services as modified.
